From Mike Tyson to Lebron James to Miles Davis to “I love NY”, tattoos are colliding with the law. This program provides a substantive overview of copyright law for either the IP expert or the non-IP general lawyer who wants to learn IP law, and dives into where tattoos collide with copyright law on infringement, implied licenses, and fair use. We look at and explore a variety of cases involving video game avatars of athletes and their tattoos, movies with tattoos, and answer the questions about who the owns the copyright and when is it infringed in these circumstances. The program explores the high-profile case involving famed photographer Jeff Sedlik and his iconic Miles Davis photograph that was used by a famous TV tattoo artist, Kat Von D, which led to significant high profile litigation that has reached the Ninth Circuit with the panel itself saying copyright law needs to be fixed.
